Developing an Effective Compliance Program
The Office of Inspector General has made quality of care in skilled nursing facilities (SNFs) a top priority. This is mainly because of the increasing number of beneficiaries living in Skilled Nursing Facilities and the unique vulnerabilities associated with this population. With the passage of the Patient Protection and Affordable Care Act, SNFs are now required to have an established compliance and ethics program. Although many health care providers have adopted voluntary compliance programs, the advent of mandatory compliance programs significantly changed the compliance landscape and undoubtedly raised the bar for health care compliance measures. Failure to implement certain core compliance program elements will create additional opportunities for regulatory and law enforcement scrutiny, as well as potential False Claims Act liability for failure to prevent or identify improper federal health care program claims and payments. The existence or lack of provider compliance program controls will be subject to enhanced focus in fraud and abuse inquiries and prosecutions.
